Terms and Conditions – Oceanscape Group Limited

1. Preliminary Statement
1.1. Medical and dental procedures carry potential risks and benefits. It is crucial to carefully consider all aspects before proceeding with treatment overseas.
1.2. Clients should consult their own doctors to determine the most suitable option for their health needs.
1.3. The initial remote assessment by medical professionals—based on photographs, medical records, and information provided by the client—does not replace an in-person medical evaluation. The final decision on suitability for treatment is made upon physical examination in Türkiye.

2. Contractual Relationship
2.1. Any contract arising from promotions, recommendations, or through the Oceanscape Group LTD website, including third-party referrals, is strictly between the client and Oceanscape Group LTD.
2.2. Oceanscape Group LTD acts solely as a facilitator for medical travel and does not provide or perform medical or dental procedures.
2.3. All travel bookings related to medical treatment are exclusively arranged through Fuzion Travel Ltd, a TAANZ-accredited travel agency based in New Zealand.

3. Medical and Dental Procedures
3.1. Accredited Medical Providers:

All medical providers are registered with the Ministry of Health in Türkiye.

Oceanscape Group LTD exclusively partners with hospitals and clinics vetted, ensuring compliance with Türkiye’s Ministry of Health regulations.
3.2. Pre-Approval and Medical Declaration:

Before traveling to Türkiye, clients must submit their full medical history for review.
-
Clients are responsible for ensuring that all medical information submitted is accurate and complete.

The treating surgeon will review the submitted medical records before accepting the client for surgery.
3.3. On-Arrival Medical Assessment:

Upon arrival in Türkiye, clients will undergo a mandatory in-person medical evaluation by the treating hospital or clinic.

The surgeon reserves the right to modify or deny the procedure based on the final in-person assessment.

If a client is deemed unfit for surgery upon arrival due to undisclosed or inaccurate medical information, Oceanscape Group LTD will not be liable for any costs incurred.
4. Payment Terms
4.1. Payment Currency & Process:

Payment for medical treatment must be made prior to travel in New Zealand Dollars (NZD) for New Zealand clients and Australian Dollars (AUD) for Australian clients.

Full payment must be received before departure, and medical procedures will only be scheduled once payment is confirmed.
4.2. Additional Costs:

The quoted price covers the agreed-upon medical procedure.
-
Additional costs may arise during the in-person assessment and will be discussed directly between the client and the medical provider.

Any extra treatments, extended stays, or further medical tests required will be paid directly to the hospital or clinic in EURO (€).
4.3. Deposit Policy:

A non-refundable but transferable deposit is required upon booking. This deposit is credited toward the final treatment cost outlined in the medical consultant’s treatment plan.
4.4. Price Variations:

Prices are subject to availability and may change due to currency fluctuations, tax changes, airfare increases, or medical provider pricing adjustments.

The total price is guaranteed only once full payment has been received.
5. Insurance Coverage
5.1. Medical Complication Insurance – Demir Medical Tourism Insurance:

All Oceanscape Group LTD clients are eligible for complication insurance provided by Demir Medical Tourism Insurance.
-
This coverage is valid only if the medical provider is officially registered with the Ministry of Health in Türkiye and part of the Demir-approved network.
5.2. Scope & Limitations:

The insurance covers medical complications arising from the procedure.
-
Insurance does not cover unrelated health issues, undisclosed pre-existing conditions, or post-operative negligence by the client.

Clients must comply with all medical provider instructions to remain eligible for coverage.
5.3. Travel Insurance – Fuzion Travel:

Travel insurance is offered exclusively through Fuzion Travel Ltd.
-
Travel insurance only covers travel-related issues as per the policy wording and does not extend to medical treatment.

Clients must carefully review and agree to the travel insurance policy terms before purchase.
6. Role and Liability of Oceanscape Group LTD
6.1. Oceanscape Group LTD is a facilitator of medical and dental treatment services in Türkiye. The actual treatments are performed by independent and certified medical professionals.
6.2. Oceanscape Group LTD is not liable for:

The quality or outcome of any medical, dental, or cosmetic procedure.

Any complications, injuries, side effects, or dissatisfaction arising from the procedure.

Any actions or inactions by the treatment providers before, during, or after the procedure.
6.3. By engaging with Oceanscape Group LTD, you acknowledge and agree that:

You are making an independent and informed decision to seek medical treatment in Türkiye.

Oceanscape Group LTD does not influence or persuade you to undergo treatment.

Oceanscape Group LTD is not responsible for the success or failure of any medical procedure.
6.4. Limitation of Liability:

Oceanscape Group LTD, its employees, directors, and partners will not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from your treatment.

You waive any claims against Oceanscape Group LTD arising from medical procedures, travel disruptions, or unforeseen circumstances related to your treatment journey.
7. Travel Arrangements
7.1. Fuzion Travel Partnership:

All travel bookings must be arranged exclusively through Fuzion Travel Ltd, a TAANZ-accredited travel agency based in New Zealand.

Clients are subject to Fuzion Travel’s terms and conditions regarding flights, accommodation, and travel disruptions.
7.2. Travel Disruptions & Liability:

Oceanscape Group LTD is not responsible for missed flights, cancellations, or visa-related travel restrictions.

Any additional costs due to travel disruptions must be covered by the client.
8. Personal Data Protection & Privacy
8.1. Information We Collect

Contact details (name, address, phone number, email).

Passport details for travel bookings.
-
Medical records (as provided by the client).
-
Payment details (processed securely).
-
Any other information required for booking services.
8.2. Data Use & Protection

Data is collected in compliance with applicable privacy laws (e.g., GDPR).

We do not sell or trade your personal information.

Your data is shared only with relevant service providers (hospitals, airlines, hotels) on a need-to-know basis.

Oceanscape Group LTD implements strict security measures to protect your data from unauthorized access, loss, or misuse.
9. Age Requirement
9.1. Clients must be at least 18 years old to engage in medical travel services through Oceanscape Group LTD.
9.2. Minors seeking treatment must have explicit parental or guardian consent and legal documentation.
10. Disputes & Governing Law
10.1. These Terms and Conditions are governed by the laws of New Zealand (for clients from New Zealand and Australia) and Türkiye (for all other clients).
10.2. Any disputes shall first be resolved through mediation. If unresolved, disputes shall be settled through the relevant courts.
11. Acknowledgment & Agreement
11.1. By proceeding with medical travel through Oceanscape Group LTD, you confirm that:

You understand and accept all terms and conditions outlined above.

You accept full responsibility for your medical decisions and treatment outcomes.

You release Oceanscape Group LTD from any and all claims related to medical or travel services.
